Official Terms and Conditions for the Rules of Play

Toluna SAS, with a capital of 381 112 euros, situated at 1 bis Rue Collange, 92300, Levallois Perret, and registered under n°432033181 with the Trade and Companies Register.

Which state:

« The company called Toluna has organised a free prize draw competition without obligation to purchase « The Opinion Surveys Monthly  Prize Draw Competition » from 7th December 2012 to 7th December 2014.

This Prize Draw is on offer to all the sites that promote Opinion Surveys in the countries listed via approved advertising (display, emailing, text links etc) with a unique tracking link that has been recuperated from the ThinkAction platform (www.thinkaction.com) belonging to Toluna. It is reserved to all participants having completed a survey residing in the following countries: Australia, Austria, Belgium, Brazil, Canada, China, Denmark, Finland, France, Germany, Greece, Hong Kong, India, Ireland, Italy, Japan, Malaysia, Mexico, Netherlands, New Zealand, Norway, Philippines, Poland, Portugal, Russia, Spain, Sweden, Switzerland, Taiwan, Thailand, Turkey, UK and the USA with the exception of the employees and representatives of the organizing company, its client, its sub-contractors and partners, members of their families and their parents or direct or indirect allies.»

In Compliance with this request:

have received by the company stated in my legal care the complete rules of said contest on three pages recto.

After having reviewed, I have attached a copy of said amendment of regulations to each one of the originals of this act.

AND FOR ALL THAT PRECEEDS, I HAVE MADE AND DRAWN UP THE PRESENT CONTRACT, IN FULL RESPECT AND ADHERANCE OF THE LAW.

Article 1 - Company

Toluna SAS, with a capital of 381,112 Euros, situated at 1 bis rue Collange 92300 Levallois Perret, and registered under n°432033181 with the Trade and Companies Register, is organising a free competition with no purchase necessary. The Opinion Surveys Monthly Prize Draw: taking place from 7th of December 2012 until 7th of December 2014.

Article 2 – Participation

This Prize Draw is on offer to all the sites that promote Opinion Surveys in the countries listed via approved advertising (display, emailing, text links etc) with a unique tracking link that has been recuperated from the ThinkAction platfrom (www.thinkaction.com) belonging to Toluna. It is reserved to all participants having completed a survey residing in the following countries: Australia, Austria, Belgium, Brazil, Canada, China, Denmark, Finland, France, Germany, Greece, Hong Kong, India, Ireland, Italy, Japan, Malaysia, Mexico, Netherlands, New Zealand, Norway, Philippines, Poland, Portugal, Russia, Spain, Sweden, Switzerland, Taiwan, Thailand, Turkey, UK and the USA with the exception of the employees and representatives of the organizing company, its client, its sub-contractors and partners, members of their families and their parents or direct or indirect allies.

In order to participate, it suffices to a survey via Opinion Surveys in the above mentioned countries. For each completed survey per calendar month, the respondent will be entered into the free competition.

Participation is not limited to a single ticket per household.
 
Article 3 - Winner Selection & Prize

A singular winner will drawn per calendar month and will win the amount mentioned in the table below corresponding to their country of residence.

The winnings will be paid by either bank wire or paypal except when the winner resides in India or China when they will be paid in Gift Vouchers.  

An email address will be drawn at random from all the emails addresses of the respondents having completed a survey per calendar month in the countries mentioned.

The respondent will be informed of their winnings by the company Toluna SAS by email. The winner authorises all verifications of their identity and residence (postal address and/or internet). 

Any false information of identity or address will invalidate the winner and all of their participation. If the winner hasn’t claimed their winnings within 15 days after receiving the winner’s email, Toluna reserves the right to choose another winner.

Article 4 - Information & Liberties

In order to participate in this prize draw competition, participants must provide certain information about themselves. This information will be saved and processed in accordance with the law n° 78-17 of 6th January 1978 relating to data, files and freedom.

Participants have the right to access, modify, rectify and delete data. Participants may exercise this right by writing to:

This data may be used by the organiser for commercial purposes subject to the express agreement of the participants.

Article 5 - Reimbursement of Expenses

Any participant in the competition can obtain on request a reimbursement equivalent to the connection charges, based on five minutes connected at a reduced rate. The reimbursement request should be sent via post to Toluna SAS, along with the participant’s bank account details, proof of address and an extract of a bill from the supplier indicating the date and time of the connection, no more than 30 days after the closing date of the competition, the letter being postmarked by the deadline. The costs incurred by the participant for the stamp necessary for this request will be reimbursed on request based on the standard ‘letter’ rate in force. Only one reimbursement request per participant subscribed to the game and per envelope (same name and same address) will be considered.

However, where the participant is making use of an unlimited internet offer, no reimbursement will be made as the participant has not incurred any extra charges by taking part in the competition.

Reimbursement requestes received by email will not be taken into consideration.

Article 6 - Liability of the Organiser

The organiser reserves the right to shorten, extend, modify or cancel the prize draw competition should the circumstances necessitate. Its responsability cannot be committed as a result or because of an internet malfunction, routing problems or loss of email.

Article 7 - Regulations

The regulation is filed in the study of Master Franck CHERKI, Bailiff 119, avenue de Flandre, 75019 Paris, France.

The rules may be amended at any time in the form of an amendment by the orgainser, in accordance with the requirements and published online in an announcement on www.opinionsurveys.com. The amendment will be filed in the study of Master Franck CHERKI, bailiff 119, avenue de Flandre, 75019 Paris, France.
The regulation is sent free to anyone making a written request to the following address Toluna SAS, 1 bis Rue Collange, 92300, Levallois Perret. The stamp required for the claim will be returned upon request based on the “letter” class rate in effect.

Article 8 - Agreement as to Evidence

It is agreed that the information contained in the IT systems of the organiser have probative value as to the connections and information elements resulting from a data processing by the organiser.

Article 9 – Litigation

Participation in a survey via Opinion Surveys entails the participation in this prize draw competition and pure and simple agreement to these rules.

Enquiries concerning the interpretation of the rules must be received in writing. A response to any request concerning the interpretation of this regulation no later than 15 days after the end of the contest.

It is agreed that the information resulting from Toluna SAS’ prize draw process (completion of a survey) can be used as evidence in any litigation pertaining to the connection and electronic data processing (EDP) of said information related to the prize draw competition. No claims of any kind can occur regarding all or part of the prize draw beyond a period of two months from the drawing of the monthly prize draw.

This regulation is subject to French Law. Any difficulties in the interpretation of this regulation and any disputed cases will be ultimately resolved by the company's Head Office.
